Lufkin man found with child porn on computer granted 10 years of probation

LUFKIN, TX (KTRE) -

An Angelina County judge gave a 69-year-old Lufkin man who was arrested in 2011 for having child pornography on his computer 10 years of "shock probation" at a hearing Wednesday morning.

Smith appeared in Judge Barry Bryan's 217th Judicial District Court Wednesday morning.

According to the conditions of Smith's probation, he will get credit for time served. During his probation period, he will not be allowed to use a personal computer. Because his wife has a laptop, her computer will be subject to frequent searches.

He will also have to register as a sex offender and adhere to strict restrictions.

Those include but are not limited to sex offender counseling, intensive supervision and polygraphs.

In addition, although Smith will be allowed to have a cell phone, his mobile device is not allowed to have access to the Internet. If Smith violates the conditions of his probation, he could face prison time.

"My understanding is that he was given probation because he had no criminal history and because of his age," Probation officer Lisa Page said. "That would make him a good candidate."

According to a previous East Texas News story, the Lufkin Police Department's investigation into Smith started on July 6, 2011. An employee at Lufkin's Best Buy store discovered files on a computer hard drive that insinuated child pornography.

According to Det. Otis Almond, Smith's wife brought the hard drive to the store to have files transferred to a new hard drive. The employee called police and reported the suspicious files. Almond said neither the employee nor the responding police officer opened the files, but the officer took the hard drive.

Almond said he executed a search warrant on the hard drive on Thursday and found pornographic images of children.

Almond interviewed Smith on Tuesday and said that he confessed to having the pornographic images. Almond arrested Smith on the charge the same day.
