Dad regains rights after appeals court ruling

The Arizona Court of Appeals says a father wrongfully lost his parenting rights after the mother of the couple's child blocked him from visits and then told a judge he had abandoned their son.

The court ruled Tuesday that the father identified in court papers as Calvin B. must have his rights restored and be allowed to visit his now-5-year-old son.

Calvin's rights were terminated in 2012 after years where his former wife hindered his ability to see their son. The court noted that Brittany B. filed for an order of protection, then called police and had him arrested when he called to arrange visits despite his right to see his son.

 

She then used his failure to visit as evidence that he had abandoned the child.
