AZ Air Guard ex-officer to avoid trial in fraud case

TUCSON, AZ (AP) -

A Tucson-based Arizona Air National Guard unit's former commander has agreed to an agreement with prosecutors that will allow him to avoid a trial on charges in an alleged scheme to defraud the government of expense pay.

According to the Arizona Daily Star, the so-called prosecution diversion agreement would require retired Col. Gregg Davies to pay back wages he fraudulently collected. In return, charges against him would be dropped.

A 2013 indictment accused Davies and 20 other current and former Air Guard members of falsifying documents to fraudulently obtain $1.4 million of additional living-expense pay between November 2007 and September 2010.

Defense attorney Lee Stein says Davies is pleased that the charges will be dismissed, while Assistant Attorney General Mike Jette cited the time and expense of holding trials.
