LUFKIN, TX (KTRE) - An Angelina County judge sentenced a 39-year-old Lufkin man who kicked in the door to his 19-year-old neighbor's apartment and attempted to sexually assault her in May 2013 to 25 years in prison for the burglary charge and 10 years each for the attempted sexual assault charges Monday.
Garland Johnson made an appearance in Judge Paul White's 159th Judicial District Court following a pre-sentencing investigation. According to Angelina County District Attorney Art Bauereiss, the prison sentences Johnson just received will all run concurrently with the sentences he is already serving for assault and bond jumping.
Back in February, a jury of four men and eight men found Johnson guilty of burglary of a habitation with the intent to commit sexual assault and attempted sexual assault after more than nine hours of deliberation. They found him not guilty on two counts of sexual assault.
Johnson is charged with sexual assault after he reportedly kicked in his 19-year-old neighbor's apartment door on Raguet Street in May 2013, then bit the alleged victim all over her body in an attempt to sexually assault her. During his trial, both sides made it clear from the beginning that there was never any intercourse just the touching of genitals.
In a previous East Texas News story, Sgt. Mike Shurley, a spokesman for the Lufkin Police Department, LPD officers responded to a 911 call about a sexual assault in progress at approximately 7 a.m. on May 25, 2013. He said the victim managed to get away from her attacker and called 911 from another location.
When the LPD officers arrived on the scene, they allegedly found Johnson inside the woman's apartment. Shurley said Johnson was completely naked and in the process of masturbating. The responding officers said it appeared as though Johnson was on some kind of drug.
Shurley said further investigation revealed that Johnson had outstanding warrants on him for kidnapping and another sexual assault that occurred in Trinity County. He added that Johnson had jumped bail on both of those charges.
The sexual assault victim told Lufkin Police officers that Johnson had come over to her apartment on two previous occasions and banged on her door, demanding that she let him inside. On Johnson's third visit, he allegedly kicked the door down and tried to sexually assault the woman.
Johnson's two theft charges were issued by another agency. According to the Angelina County Jail Website, Johnson has numerous other arrests on his record dating back to 1995, including aggravated kidnapping, aggravated sexual assault, assault, assault causing bodily injury, and criminal trespass.
