LUFKIN, TX (KTRE) - A Texas Department of Public Safety trooper arrested a 24-year-old man for allegedly driving drunk with a 12-year-old boy in the truck with him early Sunday morning.
Bryan Michael Smith was charged with driving while intoxicated with a child under the age of 15 in the car, which is a state-jail felony. He was released later Sunday after posting a $3,500.
According to a press release, a DPS trooper stopped a red Ford pickup on U.S. Highway 69 South near Loop 287 at approximately 12:55 p.m. Smith allegedly had the odor of alcohol on his breath, and the DPS trooper conducted field sobriety tests on him.
After Smith was taken to Lufkin's Memorial Hospital for a blood sample, he was transported to the Angelina County Jail.
The 12-year-old boy was released into the custody of a family member.
