22-year-old found in ditch dies at hospital

RUSK, TX (KLTV) - An East Texas man has found unconscious in a ditch on Tuesday night has now died.

According to Smith County Precinct 3 Justice of the Peace James Meredith, 22-year-old Xavier Lang was pronounced dead at East Texas Medical Center in Tyler at 7:39 p.m. Wednesday. He was airlifted to Tyler Tuesday night with head injuries.

Back in March, Lang was arrested for unlawful possession of a firearm in a federal drug sting. He was then released on bond from the Cherokee County Jail.

His mother Tracy Justice was open about his past trouble with the law.

"He was a good kid. He did do his bad things, which we all go through points in times," Justice said. "He was young. He was 22."

Justice believes someone knows how her son ended up on the side of Underwood Street in Rusk, just down the road from the Cherokee County Jail.

"I really feel that somebody had did something to him first, then knowing that he was in trouble with the law used the excuse to say oh we're taking him to the police station," Justice said.

A stranger found Lang with injuries to his head just after 9 o'clock Tuesday night.

"I just want to find some justice for Xavier because it's hard putting him in the ground and not having an answer for him on why would they do this to you," Justice said.

Lang's mother says she last talked to her son just before he was found. Shortly after that conversation, Justice says Lang's wife Jana told her Xavier was in the car with Jana's mother.

"I got a text message that says Tracy he's in Rusk. He jumped out the car," Justice said. "Anyone who knows my son knows he wouldn't jump out of a car."

While speaking with Justice, we found the man who discovered Lang on the side of the road and called 911. He says he was pulling out of McDonalds when he noticed a body on the side of the road.

"I really want to thank him because I mean without him no telling how much longer my son would've laid there," Justice said. "They just left him like a dog on the side of the road."

Justice says she thinks her son's injuries were caused by being hit in the back of the head. She's hopeful anyone who saw what happened Tuesday night will come forward.

Lang's body will be sent to the Dallas County Medical Examiner's Officer for autopsy. Once a cause of death is determined, authorities will be able to decide how the case will be investigated.  The case is under investigation.

KLTV has reached out to the Rusk Police Department, but they have been unavailable for comment.

    More than a few tar-covered tires are hanging on to the parking lot of a Lufkin tire shop.  On August 31, newly laid asphalt on Loop 287 started sticking to tires of those driving, leaving many of the cars un-driveable. As of Friday, the Texas Department of Transportation hadn't come out with an official cause for the incident, but that hasn't stopped over 600 people from filing claims with them.
