Authorities: Man killed after Angelina Co. gas station argument

ANGELINA COUNTY, TX (KTRE) -

One man is dead after Angelina County Sheriff's deputies say he was shot during an apparent confrontation Thursday night.

According to the Angelina County Sheriff's Office, the man who was shot has been identified as Timothy Austin, 44. The shooter was identified as Venable Wayne Bonham, 49.

The argument began between two men at a gas station, not far from one of their homes in the 4600 block of State Highway 103 East, according to Angelina County Sheriff's Office Captain Alton Lenderman.

Both men ended up leaving without any incident. Lenderman said one man then returned to confront the other man at his home. After another argument, the homeowner shot the man before calling law enforcement, Lenderman said.  

Austin underwent surgery at a Lufkin hospital and was initially listed in serious condition. He later died of his injuries, according to Lenderman. Bonham was detained by authorities for questioning, although no charges have been filed at this time.

Lenderman said there is the castle law that many homeowners use in cases like these that allows homeowners to use deadly force if they feel their life is threatened. Lenderman said the law is not as black and white as people think.

"Decisions that are made in a split second may take years to see if you made the right decision or not," Lenderman said. "A lot of the times what makes these things are changes in the laws and the laws are continuously changing."

Austin has had several run-ins with law enforcement in Dallas County. In 1998, Austin was charged with assault. In 2005, he faced a retaliation charge. In both cases, Austin reached a plea deal before going to court.

Lenderman said he has no reason to believe the men knew each other before the confrontation began. Lenderman said an autopsy will be ordered on Austin. This case is still under investigation.
