GREENVILLE, SC (FOX Carolina) -

Police said a Greenville man is accused of trying to commit a lewd act on a 14-year-old boy who was spending the night at a friend's house.

Greenville police said they spoke with the victim on Monday, who said he awoke to Max McKinney, 48, standing over him.

The boy told investigators McKinney touched him and made suggestive comments but the boy told him to stop, according to his arrest warrant. The warrant also stated the boy thought McKinney had already touched him or was trying to when he woke up.

McKinney was arrested and charged with third-degree criminal sexual conduct with a minor.
