LUFKIN, TX (KTRE) - A 20-year-old Lufkin man accepted a plea bargain deal of two concurrent 10-year prison sentences for sexually assaulting two underage girls in 2013. When the offenses occurred, one girl was 14, and the other one was 13.
Jekson Jobiay Turcios appeared in Judge Paul White's 159th Judicial District Court Thursday. As part of the plea bargain, Turcios pleaded guilty to first-degree felony charge of aggravated sexual assault of a child and a second-degree felony of sexual assault of a child.
The two 10-year Texas Department of Criminal Justice prison sentences will be served concurrently, or at the same time. In addition, Turcios will be required to register as a sex offender for the rest of his life.
During the court proceedings, an interpreter was needed because Turcios, who is an American citizen, only speaks Spanish.
When Torcios accepted the plea bargain, White asked if the victim' guardians had been informed of the plea bargain and Katrina Carswell, an assistant district attorney for Angelina County, said the victim of the October case has been informed and did not object to the plea bargain.
The second family has not been located or responded to phone calls or left messages, Carswell said.
White told Turcios that he was hesitant to approve his plea bargain agreement because he didn't want Turcios to think he was lucky. However, the judge reluctantly agreed to the terms of the plea bargain.
When White asked Torcios if he understands his behavior was illegal, Torcios responded that he understands having sex with two minor girls is illegal and added he knows what he did is wrong. Torcios said that he knows if he does it again, he'll go back to jail for 20 years or life.
"The law says it's illegal, and you'll be held to that standard," White said.
The two sexual assaults occurred on June 28 and Oct. 9 of 2013. Lufkin Police officers arrested Turcios on the second charge in November.
According to the arrest affidavit for the second charge, Lufkin Police officers went to Turcios' home in the 400 block of Paul Avenue on Oct. 9, 2013 to serve the warrant for the first sexual assault. When they got there, they found the second victim, a 13-year-old girl at the residence.
The victim was interviewed at Harold's House in Lufkin. During the recorded interview, the girl said that she had been at Turcios' house in the early morning hours of Oct. 9 and that she had sex with him.
Later, Lufkin Police officers interviewed Turcios. During the interview, Turcios said he had sexual intercourse with Jane Doe on Oct. 9. He also allegedly told them that over the course of the previous two months, he had sex with the girl on three to five occasions.
Turcios told police that he knew the victim was 13 years old after the third time he had sex with her, according to the affidavit.
The other sexual assault that Turcios is accused of committing took place on June 28. At that time, he allegedly had sex with a 14-year-old girl at a local hotel with three minor girls and at least one adult in the room with them at the same time.
In all, seven people were staying in the room. The alleged sexual assault occurred at the Courtyard Marriott Hotel on South First Street.
Turcios was booked into the Angelina County Jail on the first second-degree felony sexual assault charge and three misdemeanor charges on Oct. 9. He posted a collective attorney bail of $51,081 and was released from jail six days later.
According to the arrest affidavit, the victim, the three girls, and the two adults were taken to Harold's House in Lufkin for forensic interviews. The girl admitted to having sex with Turcios, according to the arrest affidavit, and the three minors and the adult also said they saw Turcios and the victim engage in sexual acts.
In the state of Texas, a child under the age of 17 cannot legally consent to have sex.
