NACOGDOCHES COUNTY, TX (KTRE) - Nacogdoches County Sheriff's deputies arrested a couple after they allegedly got into a drunken domestic dispute over a child Friday night.
John Michael Lea Jr., 38, of Douglass, and Sally Nicole Gregory, 26, of Nacogdoches, were both booked into the Nacogdoches county Jail on a state-jail felony endangering a child charge Friday night. Lea was charged with Class A misdemeanor assault causing bodily injury-family violence.
Lea has since posted a $10,000 bail and has been released from the jail. Gregory was released from the jail after she posted at $7,500 bail.
According to the arrest affidavit, NCSO deputies responded to a report of an unknown situation on Macon Drive. While they were en route to the scene, dispatch told the deputies that a woman had begun screaming that her child was missing. They were later told that the subjects had left the scene.
When the deputies got to the scene, the complainant told them that a man, a woman, and a small child had left with someone on a white pickup. After the NCSO learned a possible address for the child, they went to the home to conduct a welfare check on the child.
Gregory came out of the home when the deputies arrived on the scene, and they noticed scratches on her neck and arm, along with bruising on both of her arms, according to the affidavit. When the NCSO deputies asked Gregory what had happened, she allegedly became belligerent with them and displayed signs of severe intoxication including slurred speech, glassy and bloodshot eyes, and unsteadiness on her feet.
According to the affidavit, Gregory also had a strong odor of alcohol on her breath.
The deputies asked Gregory where the child was, and she said he was inside with her husband and that they were in bed, the affidavit stated. When the deputies asked to see the child to make sure he was OK, Gregory became "irate and more belligerent" with them.
The affidavit stated that Gregory told the deputies that they were not welcome in her house and that they couldn't go inside. Because they were concerned about the boy's safety, the deputies went inside the home any way and found the child in the bed with Lea.
When the deputies woke Lea up, he became irate and belligerent as well, according to the affidavit. He also allegedly threatened to assault one of the deputies.
Based on the statements from witnesses of a possible disturbance between Gregory and her husband, the child being the center of the dispute, and the fact that both husband and wife were allegedly extremely drunk, the deputies felt like if they had left the child with his parents, his safety would have been at risk, the affidavit stated.
Both Lea and Gregory were arrested at the scene and transported to the Nacogdoches County Jail.
