Affidavit: Burke man took nude photos of 11-year-old girl

ANGELINA COUNTY, TX (KTRE) -

Angelina County Sheriff's deputies arrested a 46-year-old man after he allegedly took nude pictures of an 11-year-old girl who was staying at his house.

John Michael Marino is still being held in the Angelina County Jail on a third-degree felony charge of indecency with a child and a state-jail felony charge of improper photo or visual recording. No bail has been set at this time.

According to the arrest affidavit, the parents of the 11-year-old girl spoke to Angelina County Sheriff's Office deputies and alleged that Marino had taken nude photos of their daughter. Later, Marino's wife told an ACSO investigator that the victim had been spending the night at their house on June 6.

The wife told investigators that she was awakened by a noise, and she walked into her living room to check on the girl. According to the affidavit, the wife said that she found the girl lying on the couch with Marino between her legs with a light believed to be from a cell phone.

When the wife took the cell phone away from Marino, she allegedly found nude photos of the victim on it.

Angelina County Sheriff's investigators obtained a search warrant for Marino's phone, and it allegedly contained nude photos of the girl. In addition, the photos were sent to an unknown person via text, the affidavit stated.
