Lufkin man indicted for allegedly sexually assaulting young girl multiple times

LUFKIN, TX (KTRE) -

A 38-year-old Lufkin man who allegedly sexually assaulted a young girl multiple times at several different locations was among the 52 indictments passed down by an Angelina County grand jury.

Jose Francisco Barron-Villafana was indicted a first-degree felony charge of continuous sexual assault of a child and a felony aggravated sexual assault of a child charge. Barron-Villafana is still being held in the Angelina County Jail. His bail has been set at $20,000.

Barron-Villafana is also being held on an Immigration and Customs Enforcement hold.

The victim's mother came to the Lufkin Police Department on July 22 and told officers that her daughter had been in a sexual relationship with man. She said that on that day, she went into her daughter's room and found her on a cell phone even though the girl wasn't supposed to have a cell phone.

According to the affidavit, the mother took the phone away from the girl and asked her where she had gotten it. The victim allegedly told her mother that Barron-Villafana had given her the cell phone, so they could stay in touch.

The mother looked through the cell phone and realized that her daughter and Barron Villafana had been communicating via text messages, the affidavit stated.

“[The mother] stated that after reading the messages, it was clear that [her daughter] and Barron had entered into an inappropriate relationship,” the affidavit stated.

The mother later found a hand-written letter talking about the relationship and the fact that the victim was pregnant, the affidavit stated.

When the girl was interviewed at Harold's House on July 23, she told the forensic interviewer that Barron-Villafana was her boyfriend and had been for some time, the affidavit stated. The victim allegedly told the interviewer that she and Barron-Villafana had sex with her in her bed in June 2013 and on a couch in the residence in January 2014.

According to the affidavit, the victim told the interviewer that their third sexual encounter occurred in May 2014. The girl said after her mother dropped her off at church, she met with Barron-Villafana in the parking lot and had sex in the back of his truck.

The affidavit stated that Barron-Villafana was arrested for no driver's license when he was en route to his home in the 3500 block of oak Wood Drive on July 23. He was taken to the Lufkin Police Department for questioning in the sexual assault case.

Barron-Villafana allegedly confirmed everything that the victim had said about their inappropriate relationship. According to the affidavit, Barron-Villafana told LPD investigators that he and the girl had more sexual encounters than the number she gave authorities, including one in a church parking lot.

Even though Barron-Villafana allegedly admitted that the relationship was improper and that he he knew that he would get caught eventually, he entered into the relationship with the girl, so he could “remove her from the abusive relationship she had with her parents.”

According to Texas law, a child under the age of 17 cannot legally give consent to have sex.

The Angelina County grand jury also indicted Brandon Taylor Willis, 19, of Lufkin, for criminal solicitation of a minor.

According to the arrest affidavit, the 11-year-old girl's mother filed a report with the Lufkin Police Department on May 19. The report stated that her step-daughter was being sexually solicited via the girl's Facebook account.

When the mother met with a LPD detective, she explained that she had personally viewed her daughter's account and reviewed a lengthy conversation between the girl and Willis. Upon reading the sexually explicit portions of the conversation, the mother confronted Willis through the same account after identifying herself as the girl's mother, the affidavit stated.

Jon Michael Marino, 36, of Burke was indicted on two felony charges - indecency with a child and improper photography/visual recording.

According to the arrest affidavit, the parents of the victim, an 11-year-old girl, spoke to Angelina County Sheriff's Office deputies and alleged that Marino had taken nude photos of their daughter. Later, Marino's wife told an ACSO investigator that the victim had been spending the night at their house on June 6.

Also indicted was Xavier Dashon Levine, 19, of Diboll. He was indicted for aggravated assault with a deadly weapon in connection to allegations that he shot another young man in the right hip during a brawl that occurred on Eleanor Street back in July.

James Garrett Jr., 39, of Lufkin, was indicted on an aggravated assault with a deadly weapon charge for allegedly threatening his girlfriend with an ax back in December 2013.
