Center attorneys disagree; Fountain murder case recessed

CENTER, TX (KTRE) - Rebecca Fountain, 34, is a Center woman accused of stabbing a Nacogdoches man in 2012. 

Throughout her two year criminal process, Fountain has already had two attorneys.

Last Monday, her court appointed attorney, Robin Goodwin, filed several motions concerning the case.  He and the district attorney, Kenneth Florence, got into a physical altercation, after one disagreement in the courthouse according to his motion.

According to Goodwin's motion, canes were swung and books were thrown.

Florence has recused from the case.

Today's hearing concerned the gross prosecutorial misconduct motion. There were over five witnesses present.

 The judge, however, recessed the case again today, after requesting a subpoena of an email from Florence to a local newspaper. 

The newspaper's representative said,"I don't see how this information is relevant to a murder trial."

Defense attorney, Goodwin said, "It's none of your business." 

The case of gross prosecutorial misconduct has been set to December 8, and Fountain's case has been set to April 2015.
