LUFKIN, TX (KTRE) - A Texas Department of Public Safety spokesman said that the man who died in a rollover crash on US Highway 59 north of Lufkin on Jan. 6 had a blood-alcohol level that was above the legal limit.
Trooper David Hendry said on Friday that the toxicology report indicated that Marty Jay Allen, 55, of Lufkin, had a blood-alcohol level that was over the legal limit of .08. However, Hendry said he was unable to give Allen's exact blood-alcohol level.
Allen died at the scene at 7:15 p.m. on Jan. 6.
According to the DPS report, Allen was driving a 1998 Chrysler Sebring northbound on US 59, three miles north of Lufkin, at 6:53 p.m., when he left the road to the right, struck a culvert and overturned.
He was not wearing a seatbelt.
