DA drops case against man accused of burning girl with cigarette

ANGELINA COUNTY, TX (KTRE) -

The Angelina County District Attorney's Office has dropped the case against a Huntington man accused of burning the hand of a four-year-old girl, one day before he was set to go to trial.

Bryan Craig Ybarguen, 35, was charged with third-degree injury to a child.

Deputies arrested him in May 2013, after the girl's father reported his daughter said Ybarguen had burned her with a cigarette and hit her with a cane pole.

District Attorney Art Bauereiss said he had to dismiss the case after learning more information.

"Unbeknownst to me until yesterday, the victim had given inconsistent versions of how she was injured," Bauereiss said.

Ybarguen was scheduled to go on trial Tuesday.
