NACOGDOCHES, TX (KTRE) - Nacogdoches Police officers arrested a 24-year-old registered sex offender Tuesday in connection to allegations that he sexually assaulted a 16-year-old girl and got her pregnant.
Aterrius Deonate Berry, of Nacogdoches, is still being held in the Nacogdoches County Jail on a second-degree felony sexual assault of a child charge. No information was available on his bail amount.
According to the arrest affidavit, an NPD officer responded to a disturbance at a residence on Daybreak Drive on Feb. 5. When the officer arrived on the scene, he met with Berry, whom he discovered was a registered sex offender, a woman, and her 17-year-old daughter.
The mother told the Nacogdoches Police officer that Berry had been at her house and was acting disrespectful. After Berry was issued a criminal trespass warning, he left the scene, the affidavit stated.
Then the girl told the NPD officer that she and Berry had been having sexual relations for about two months. She also told the officer that she was pregnant, the affidavit stated. In addition, the NPD officer learned that the girl had just turned 17 within the past few days.
On Feb. 6, the NPD detective who sought the arrest affidavit spoke to the girl's mother, who told him that her daughter was approximately seven weeks pregnant, according to the affidavit. When the detective spoke to Berry, he allegedly "freely admitted" to having sex with the girl and that the child was his.
The NPD detective spoke to Berry again on Feb. 10, and he said that the child had been conceived at an apartment located in the 300 block of Ellington Street, the affidavit stated. Later that day, the detective talked to the girl's mother again, and she confirmed that her daughter was 16 when the unborn baby was conceived.
