Affidavit: Man molested 7-year-old girl at San Augustine birthday party

SAN AUGUSTINE, TX (KTRE) -

Officers with the San Augustine Police Department arrested a 33-year-old man on an indecency with a child charge in connection to allegations that he molested a 7-year-old at a birthday party on April 11.

Miguel Gomez, of San Augustine, is still being held in the San Augustine county Jail on a second-degree indecency with a child charge. His bail amount has been set at $100,000.

According to the arrest affidavit, the-year-old's mother came to the San Augustine Police Department on April 13 and said that Gomez had touched her daughter inappropriately. She told police that she had attended a birthday party at a house on Grand Street, and the children were asleep in a room while the adults continued the party outside.

The victim's mother told police that her daughter came outside crying and said that Gomez had touched her inappropriately, the affidavit stated. The woman said she left with her daughter and came back to the house on Grand Street to confront Gomez and his brother.

According to the affidavit, Gomez said he was drunk and didn't what he had done. However, the brother said that he had seen Gomez sitting on the bed that the girl had been sleeping on and that he had seen the girl crying.

When a San Augustine PD officer interviewed the alleged victim, she said that she and the other children were in a room watching cartoons and sleeping. She said that Gomez grabbed her by the waist and touched her on the buttocks, the affidavit stated. Then Gomez allegedly pulled her pants down and touched her inappropriately.

The girl told the officer that Gomez let her go when she started crying, the affidavit stated.

While the SAPD officer was interviewing the mother and her daughter, she received word that Gomez and his brother had gone to the San Augustine County Sheriff's Office. A Spanish-speaking deputy from the Shelby County Sheriff's Office helped with the interview because of the language barrier.

Gomez' brother told authorities that he had gone into the room to lay one of his children down to sleep, and he saw Gomez sitting on the bed that the victim was lying on, the affidavit stated. After the brother left the room and returned a few minutes later, he saw that the girl was crying, and she said that Gomez had touched her.

During the interview, Gomez said that he wanted to turn himself in and pay for what he had done, according to the affidavit. He said that he went into the bedroom to wait for the bathroom and sat on the bed that the victim that he had been lying on and that he didn't remember touching the girl or that she had started crying.
