Man gets 40 years in Houston Co. sex assault case

HOUSTON COUNTY, TX (KTRE) - After a four-day trial, a Houston County jury found a 64-year-old man guilty of sexual assault of a child, sexual assault of a disabled person, and a third sex-related charge and sentenced him to a total of 40 years in prison.

Houston County District Attorney Donna Gordon Kaspar said that the jury sentenced Charles Duane Bennett to 15-, 25-, and 10-year Texas Department of Criminal Justice prison terms after three and a half hours of deliberation.

The judge in the case opted to stack the first two sentences and make the third concurrent, which essentially means that Charles Bennett will be serving a 40-year prison sentence unless he is paroled, Kaspar said.

"I thought it was about right, especially after the judge stacked the sentences," Kaspar said.

Kaspar said there was just one victim. It started when she was a child and continued until she was an adult, but disabled

Kaspar said the case against Sheila Bennett, 51, is pending. She did not testify against her husband, per her lawyer's advice, the district attorney added.

Charles and Sheila Bennett were arrested on July 3, 2013. The arrests came after an investigation by the Houston County Sheriff's Office.
