LUFKIN, TX (News Release) - Lufkin Police officers arrested a registered sex offender who attacked a city employee after exposing himself and making sexual gestures toward another city employee near Lufkin City Hall Wednesday morning.
Sammy Pervis Gardner, 57, of Lufkin, is still being held in the Angelina County Jail on a third-degree felony assault of a public servant charge. No bail amount has been set at this time.
According to a press release, LPD officers responded to Lufkin City Hall parking lot at about 11 a.m. Wednesday and saw a female city employee running toward Louis Bronaugh Park. In the park, Dale Allred, the city's director of inspection, was on the ground and was being punched by a man later identified as Gardner, the press release stated.
Gardner allegedly had a closed butterfly knife in his hand at the time of the attack and had been using it as a weight to increase the impact of his punches.
"As officers approached, Gardner ran toward the woman, so they drew their Tasers and told him to stop and get on the ground," the press release stated. "After being told several times, Gardner turned around and put his hands behind his back. The officers then placed Gardner under arrest."
Before the alleged attack, Allred had just confronted Gardner about exposing himself to the female city employee over the past several months, the press release stated. He told the officers that the woman did not report the incidents because she wanted to get proof.
"The woman told officers that sometimes she'll arrive at work to find Gardner pacing at the park near the lot where she parks," the press release stated. "She said he will sometimes be masturbating and though she has tried to get video proof, she has not been successful. She said that today he left a dildo sex toy in front of her work truck near the driver's side door."
Allred received treatment at Urgent Doc for a cut to his head that needed stitches, the press release stated.
In addition to the assault of a public servant charge, Gardner was also given a criminal trespass warning for the park.
Additional charges against Gardner are pending, the press release stated.
According to the Texas Department of Public Safety's online sex offender registry, Gardner was sentenced to 20 years in prison in March of 1979 for sexually assaulting a 20-year-old woman. He was also convicted of indecency with a child by exposure in November of 2003 and was sentenced to 10 years in prison for that offense.
