NACOGDOCHES, TX (KTRE) - Attorneys have selected a jury to hear the trial of a Nacogdoches man accused of shooting and killing two men in January 2014.
Decobie Durden, 38, is charged with capital murder.
Durden is accused of shooting two friends, Deveston Flemon and William Cole, at the Eastwood Terrace Apartments.
Witnesses in the area believe Durden got in an argument with Flemon and shot him in the head. Cole tried to leave and that is when Durden may have shot him in the back.
The trial starts Sept. 21 in Judge Ed Klein's courtroom. The state will not pursue the death penalty, meaning Durden's punishment will be a life-without-parole sentence, if he is convicted.
