Affidavit: Nacogdoches man caught in act of stealing pistol shot in leg

NACOGDOCHES COUNTY, TX (KTRE) -

A 28-year-old Nacogdoches man was arrested on three felony charges Sunday after he allegedly broke into a vehicle on FM 2259, stole a pistol, and pulled a gun on the two people who caught him in the act.

During the ensuing struggle over the gun, the man wound up getting shot in his leg, according to the arrest affidavit.

Charles Daniel Ortiz is still being held in the Nacogdoches County Jail on two second-degree felony aggravated assault with a deadly weapon charges and a state-jail felony theft of firearm charge. Collectively, his bail amount was set at $110,000.

According to the arrest affidavit, Nacogdoches County Sheriff’s Office deputies responded to deadly conduct call in in the 300 block of FM 2259at about 3:37 a.m. Sunday. While they were on their way to the scene, dispatch told the deputies that two people had caught an unknown person breaking into a vehicle and stealing a pistol.

When the two complainants confronted Ortiz, he allegedly pulled a pistol from his waistband. At that point, the three people fought over the gun, and in the ensuing struggle, Ortiz was shot in the leg, the affidavit stated.

The NCSO deputies found Ortiz lying face down on the ground. By then the complainants had taken the pistol from Ortiz and removed its magazine and the chambered round, the affidavit stated.

Ortiz was then transported to the Nacogdoches Memorial Hospital emergency room for treatment of a non-life-threatening gunshot wound.

The affidavit stated that Ortiz injured the two complainants with a knife after they disarmed him. Based on the alleged victims’ written and verbal statements and the physical evidence observed at the scene, Ortiz was arrested after he was released from the Memorial ER.
