Trial Ends In Hung Jury

After deliberating for a few hours the trial of a 30-year-old Diboll man ended with a hung jury. It was declared a mistrial and it will have to be re-tried.

Tyson Spencer is charged with aggravated assault of a peace officer.

In court, the jury listened to Spencer's side of the story.

According to the Angelina County district attorney, back in September, Sgt. Steve Baker of Diboll arrested Spencer for a criminal trespassing warrant. When he was brought to the station Spencer allegedly shoved Baker into a wall. When Baker tried to restrain Spencer, he was struck again.

Spencer says Sgt. Baker was aggressive first, but Baker say he was trying to defend himself.
