Affidavit: Lufkin man pushed girlfriend while she was holding 1-year-old

LUFKIN, TX (KTRE) - Lufkin Police officers arrested a 32-year-old man on March 10 in connection to allegations that he got into an argument with his girlfriend while she was holding her 1-year-old child and pushed her down.

The 1-year-old girl was injured when her leg got caught in the storm door's self-closing mechanism.

Damarcus Antwan Herring, of Lufkin, is still being held in the Angelina County Jail on a third-degree intentionally or knowingly injuring a child charge and two misdemeanor traffic charges. Collectively, his bail amount has been set at $6,000.

According to the arrest affidavit, officers were dispatched to Locke Street in reference to an assault. They were told that the complainant was waiting for them at the animal clinic.

When the officers met with the woman, she told them that she and Herring, her boyfriend got into an argument. Then after she picked up her 1-year-old girl and tried to leave the home, Herring allegedly pushed her, causing her and her daughter to fall into the doorway of the residence.

The woman told police that when she fell, her daughter's leg got caught in the storm door's self-closing mechanism.

The LPD followed the woman to her apartment in the 500 block of Locke Street and found that the door was locked. Then the woman told the officer that she needed clothes for her daughter and other items, so she could leave, adding that she was scared of Herring because he had said he would kill her and her mother, the affidavit stated.

After the woman called her landlord, and his key didn't work, the LPD officer called a locksmith, who opened the door of the residence. According to the affidavit, after the officers on scene cleared the apartment, they noticed a man in a black shirt speak to the landlord and hand him a key.

The LPD officer remembered that he had seen the man in the yard and at a neighboring residence and that the man had been talking on a phone, the affidavit stated. He also recalled that the girlfriend kept getting calls from Herring, but she would never say where he was when the officer asked.

When the LPD officer approached Herring and asked for his ID, the man refused. However, the officer took the girlfriend off to the side and asked her who the man was, and she said it was Herring.

The girlfriend told the arresting LPD officer that she was going to take her daughter to the doctor to get checked out. The child screamed and would not stay still every time the woman tried to hold her still, so an officer could photograph the injury to her leg.

The woman told police that Herring had assaulted her before and that he had threatened to kill her and her mother.

Herring was arrested at the scene and taken to the county jail.
