LUFKIN, TX (KTRE) - A Lufkin woman who stole a package from a home on FM 326 and assaulted an Angelina County Sheriff's Office deputy when authorities tried to take her into custody back in September of 2015 accepted a plea deal that made her a free woman again.
Abra Nancy Nicol, 27, appeared in Judge Paul White's 159th Judicial District Court Friday morning. As part of the plea deal, Nicol's original charge of third-degree felony assaulting a public servant was reduced to a Class A misdemeanor assault, and she agreed to nine months in the county jail.
Because Nicol got credit for the time she has already served in the county jail, she will be discharged.
When Nicol was arrested on Sept. 20, 2015, she was originally charged with third-degree assault of a public servant, Class A misdemeanor resisting arrest, and Class B misdemeanor theft.
According to the report, a resident on FM 326 called the sheriff's office on Sunday in connection to a missing package. He said he had a flashlight on the way to the house valued at $240. He said the package was not there, even though the mail carrier said it had been delivered.
The man said he checked with neighbors, who said the package was at Nicol's home. Deputies went there and spoke with Nicol, who brought the package out.
According to the report, Nicol told deputies the package came to her home, even though it had the neighbor's address on it, and she was going to keep it.
Deputies went to arrest Nicol and reported Nicol started to scream and kicked the deputy in the chest. They then were able to walk her to the car until she kicked the same deputy in the groin, according to the report.
