San Augustine Co. Sheriff's Office: 3 arrested after child custody exchange becomes brawl

SAN AUGUSTINE, TX (KTRE) -

Deputies with the San Augustine County Sheriff’s Office arrested three people earlier this week after a heated child custody exchange allegedly got physical, and an elderly woman got pushed to the ground in the melee.

Amber Lara, 19, was charged with assault against an elderly person, and Aaron Smith, 18, was charged with assault causing bodily injury and injury to the elderly. Ricky Lara Jr., 17, was charged with assault causing bodily injury. All three suspects are still being held in the San Augustine County Jail.

Chief Deputy Gary Cunningham with the San Augustine County Jail said that SACSO deputies were dispatched out to County Road 415 on June 26 in reference to an assault.

Cunningham said a man and a woman went to a house to pick up an 11-year-old. Because they were not allowed on the property, yet they were OK to get the child. As a result, they pulled into the driveway of a nearby home and waited.

While they were waiting, Amber Lara, Ricky Lara Jr., and Smith pulled up in a vehicle and started yelling at the other two people about them not taking the child.

Smith allegedly grabbed the child and started pulling him or her to the point that the child started screaming and crying.

Reading from the report, Cunningham said that Smith said, “You are not going with them.”

The two people who came to pick the child up told Smith to let him or her go, and when he didn’t do so, the elderly woman tried to grab the child, Cunningham said. He said the woman stomped on Smith’s foot to get him to let the child go.

At that point, Smith allegedly said, “Come on, b----. I’ll punch your lights out” and went after the woman.

Cunningham said Ricky Lara Jr. and Smith then went after the male victim. He said while they were beating on him, Amber Lara ran to the elderly woman and tried to hit her with a cell phone. She allegedly pushed the elderly woman to the ground.
