Livingston man accepts 10 years probation for sexually assaulting 16-year-old

A 29-year-old Livingston man accepted a plea bargain deal of 10 years of probation for sexually assaulting a 16-year-old girl twice.

As part of the plea bargain deal, Brandon Lee James pleaded guilty felony sexual assault of a child charge. In addition to serving 10 years of probation, James will also have to attend sex offender counseling and register as a sex offender for the rest of his life.

Det. Leon Middleton with the Livingston Police Department, said in 2015 that they received a call from a mother saying that she had found some disturbing texts on her 16-year-old daughter's cell phone.

“We investigated the texts and found that her daughter had a relationship with James and that the two had sex on two different occasions,” Middleton said.
The warrant for James' arrest was issued on Jan. 23, 2015.

In the state of Texas, a child under the age of 17 cannot legally give consent to have sex.
