Affidavit: ACSO sergeant catches Nacogdoches man in act of sexually assaulting girl in car

ANGELINA COUNTY, TX (KTRE) -

An Angelina County Sheriff’s Office deputy arrested a 19-year-old man on a felony sexual assault of a child charge after he allegedly caught the young man in the act of having sexual intercourse with a 15-year-old girl in the back seat of a car Friday.

Andrew Jordan Preciado, of Nacogdoches, was booked into the Angelina County Jail on a felony sexual assault of a child charge. He posted an unspecified bail amount and was released on Saturday.

According to the arrest affidavit, an ACSO sergeant was on patrol at about 1:43 a.m. on Friday when he noticed a white 2004 Volkswagen car parked on the side of the road in the 700 block of FM 842. As the sergeant was checking the vehicle registration, he noticed two people “sit up” in the back seat of the Volkswagen when he shined his spotlight on the car.

When the ACSO sergeant spoke to Preciado, he told the deputy that a” friend” was in the car as well. At one point, Preciado allegedly denied that he and the other person had been having sex. However, Preciado contradicted himself later when he responded to a question from the ACSO detective, the affidavit stated.

Then the deputy spoke to the other person in the car, and she told him she was 16, the affidavit stated. The victim told the ACSO sergeant that she and Preciado had been having sex, the affidavit stated. When the deputy asked Preciado about what had been going on again, he allegedly admitted to having sex, the affidavit stated.

Another ACSO deputy arrived on the scene a short time later, and he noticed that the girl had her sweatshirt on backward as she got out of the Volkswagen. The alleged victim told the second deputy that she was 17, the affidavit stated.

Later, the ACSO deputies determined that the alleged victim was actually 15, the affidavit stated.

The girl was taken to Harold’s House in Lufkin for a forensic interview and a SANE exam. During the forensic interview, the alleged victim said she and Preciado had consensual sex while they were in the back seat of the Volkswagen, the affidavit stated.

In addition, the victim also told the interviewers that she told Preciado that she was 15, and he had said something about her being “young,” the affidavit stated.

Later that morning, an ACSO detective interviewed Preciado, and he allegedly admitted to having sex intercourse with the victim.
