29-year-old woman arrested for alleged 2014 Nacogdoches County sex assault of child

NACOGDOCHES, TX (KTRE) -

Deputies with the Nacogdoches County Sheriff’s Office arrested a 29-year-old woman Monday in connection to allegations that she sexually assaulted a 14-year-old boy in November of 2013.

Rebecca Jolene Rigby is still being held in the Nacogdoches Jail on a second-degree felony sexual assault of a child charge. No bail amount has been set for the charge yet.

According to a previous East Texas News story, Precinct 4 Constable David Stone said Rigby was accused of having sex with a 14-year-old boy in Etoile in November of 2013. Stone said authorities obtained a warrant for Rigby’s arrest in February of 2014.

Stone said Rigby had been in Anaconda, Montana, and she refused extradition after local law enforcement agencies worked with the U.S. Marshals Service to pick her up for Nacogdoches County's Pct. 4 Constable's Office. The constable said they had to get a governor's warrant from the Nacogdoches County District Attorney's Office to get Rigby moved back to Texas.

"When they refuse extradition, we have to start the long ordeal to get them back," Stone said.

Information from family members, tips, and posts on Facebook led detectives to believe Rigby was in Montana, Stone said. He added that his office also got some calls after the second story aired on East Texas.

East Texas News obtained a copy of the arrest affidavit for Rigby Tuesday. The affidavit stated that the initial outcry was made by the 14-year-old victim's grandmother, sister, and another individual who came to the Pct. 4 Constable's Office  on Feb. 14, 2014, to report a sexual assault of a child.

The woman told the constable and his chief deputy that her granddaughter had come to her and said her brother had sexual intercourse with Rigby, the affidavit stated.

The victim's sister told authorities that just before Thanksgiving of 2013, her grandmother was in the hospital, and her brother asked her to ask Rigby to spend the night with them at their home in Etoile, and she did, the affidavit stated. According to the victim's sister, she, her brother, and Rigby all slept in the same bed. The victim was in the middle, his sister was on one side of him, and Rigby was on the other side. 

The victim's sister told authorities that her brother told her the next day that he and Rigby had sex, the affidavit stated. According to the affidavit, the boy told his sister that he had kissed Rigby before that night.

With the grandmother's permission, the victim's sister showed the constable and his chief deputy Facebook messages exchanged between Rigby and the victim on Nov. 15, 2013.

"Messages suggest that sexual intercourse had taken place between [the victim] and defendant," the affidavit stated. "Offense is believed to have occurred on November 14, 2013."

In one of the messages, the victim allegedly asked, "Did you have fun?"

The affidavit stated that Rigby responded with a message that said, "Yes, baby, I did."

According to the affidavit, the Facebook messages between Rigby and the victim continued that discussion.

Stone talked to the victim on February 14, 2014, the affidavit stated. The boy told the constable that he asked his sister to contact Rigby about spending the night with them. The victim said they all slept in the same bed, and after his sister went to bed, the victim and Rigby started kissing, the affidavit stated. The boy also admitted to having sexual intercourse with Rigby, the affidavit stated.

Later in the interview, the victim told Stone that he and Rigby had kissed before that night, but they had only had sex once, the affidavit stated.

Stone told the victim that a criminal investigation was taking place and the boy was not supposed to have any more contact with Rigby, the affidavit stated.
