POLK COUNTY, TX (KTRE) - A Baytown man has been arrested by Polk County Deputies after they allege that he sexually assaulted a woman while she was under the influence of drugs and could not defend herself.
Gregory Tolleson,58, was booked into the Polk County Jail on Saturday for sexual assault and bonded out the next day.
According to the arrest affidavit, on May 19, Polk County Deputies responded to an address in Leggett after they were called about a sexual assault of a female. The document stated that a homeowner who is considered a witness walked in to the home and discovered Tolleson having sex with her friend while she was passed out from drugs. The homeowner told investigators that earlier she saw Tolleson down the road and then noticed he was later gone and that's about the time she walked back in the home and saw him inside with her friend.
The affidavit continues, stating that the alleged victim could not speak while she was being treated by EMS due to a large amount of prescription medication she had taken.
An investigator stated that Tolleson denied that he had sex with the alleged victim but he could not explain why the witness said she saw him in the house having sex with the friend.
