Livingston man who exposed self to teen agrees to 10 years of deferred adjudication

LIVINGSTON, TX (KTRE) -

A 44-year-old Livingston man who exposed himself to a 15-year-old girl and tried to video her in the bathroom agreed to a plea deal of 10 years of deferred adjudication.

Polk County District Attorney Lee Hon said Thursday that Kelly Michael Mayton, 44, pleaded guilty to a third-degree indecency with a child by exposure charge as part of the plea bargain deal. Hon added that the sentence was the maximum length of probation and the only type of probation the law allows for that offense.

Mayton will be required to adhere to terms similar to those that would apply to a person who is serving probation. In addition to being assessed a $3,000 fine, Mayton will also be required to register as a sex offender and obey all the other standard terms and conditions of a sex offender probation, Hon said.

“This agreed disposition avoided the juvenile having to testify in trial regarding the circumstances of the offense,” Hon said.

Hon said Mayton entered a written stipulation in open court admitting to the allegations in his indictment and waived his right to appeal the sentence. 

According to a press release from the Polk County Sheriff’s Office, the mother reported the crime on Feb. 23. She said her daughter told her that Mayton has been exposing himself to her and even tried to video her in the bathroom.

Mayton confessed to the crime, according to the press release.
