Officers with the Lufkin Police Department arrested a 28-year-old man Tuesday morning after he went through the roof of Cherry’s Grocery in an attempt to steal money from the ATM.

After LPD officers arrived on the scene, the suspect allegedly hid in the neighboring washeteria’s bathroom.

Danny Delain Davenport, of Lufkin, is still being held in the Angelina County jail on two state-jail felony burglary of a building charges and a Class A misdemeanor failure to identify as a fugitive/give false information charge. Collectively, his bail amount has been set at $6,500.

According to a Jessica Pebsworth, a spokeswoman for the Lufkin Police Department, LPD officers were dispatched out to the store after a clerk arrived around 4 a.m. Tuesday and found a ceiling tile missing from the bathroom. In addition, the ATM had been pried open, and there were power tools scattered all over the floor.

The LPD officers reviewed the surveillance video and found that the suspect, who was later identified as Davenport, had fled back into the ceiling and was likely still in the store. 

“Officers found that he had locked himself in the neighboring washeteria bathroom,” Pebsworth said. “While attempting to get the door open, they began to hear noises coming from the ceiling and found the bathroom empty.”

After Lufkin Fire Department personnel arrived on the scene a short time later, LPD officers were able to use their ladders to access the roof, where they found a hole had been cut, Pebsworth said.

“After nearly an hour of searching the building, they found Davenport and took him into custody at 5:20 a.m.,” Pebsworth said. “He initially gave a fake name.”
In the video, one of the LPD officers could be seen shining a laser up at Davenport.

“Come out through the hole where you see the red laser shining,” the officer said. “Let me see your hands. Come out slow, and you won’t get hurt. Gig’s up.”

Davenport was arrested at the scene without further incident and taken to the county jail.

Pebsworth said in addition to the charges Lufkin PD filed on Davenport, he also had a warrant out of California for violating conditional release.
