Gary Batchelor Junior will remain a juvenile. He's one of the six defendants connected with the October murder of James Kelly Senior in Cushing. The capital murder allegation and adult certification against Batchelor were abandoned. He pleaded guilty to an aggravated sexual assault charge and an evidence tampering charge. In exchange the 16 year old is sentenced to the Texas Youth Council. He can remain under their supervision until his 21st birthday, unless parole is granted. Batchelor and one other teen maintained their juvenile status. Others accused in the murder plot include kelly's stepdaughter and wife.
