Convicted Killer Will Stay on Death Row, For Now

An Angelina County judge has ruled a convicted killer is not mentally retarded and should remain on death row.

The ruling must now go before nine judges on the Court of Criminal Appeals. Their ruling will take several months.

If they agree with the current report, an execution date will be set for David Lee Lewis. If they change the ruling, his death sentence will be commuted to life in prison.

Lewis' lawyers said he is mentally retarded and his IQ is too low to keep him on death row.

Lewis shot 74-year-old Myrtle Ruby to death 20 years ago after breaking into her home.
