Trashing East Texas:Tyler Businessman Facing Felony Charges

The pile-up of trash is enormous; paint cans, insulation, and old mattresses are all things that can be harmful to the environment if they're not properly disposed.

Sergeant Danny Brasher with the Smith County Environmental Crimes Unit says, "Once it gets dew on it or it rains on it, any of the chemicals that are involved in it, the rain pushes them right into the ground. That's where the environmental issues come in."

Brasher says the property belongs to Miles Brosang, the owner of Brosang Landscaping in Whitehouse. It's littered with hundreds of used landscape pots, and an old dump truck Brasher says is registered to Brosang's company. Most of the trash should have been taken to the Smith County landfill, something Brasher says would have cost thousands of dollars.

"It bothers me a lot, especially with someone like Mr. Brosang, because he's been given awards by Keep Tyler Beautiful for some of the things that he's done in the community, and for him to do this for pure economic gain, it's beyond me," says Brasher.

This is not the first time Brosang has been in trouble for environmental violations. According to the Smith County Judicial website, Brosang was charged with 3 Class C misdemeanors for illegally transporting solid waste, illegally dumping trash and violating the burn ban in July. 

"He has been warned what the environmental laws are and not to violate those laws," says Brosang.

Now, Brosang is facing felony charges for the dumpsite which could put him in jail for two years and cost thousands in fines and clean up costs.

We spoke with Miles Brosang today to get his comments on the charges. He told us he would only comment through his attorney who could not be reached. He is expected to turn himself in at the Smith County Jail tomorrow morning.
