LUFKIN, TX (KTRE) - Lufkin police now say a third person has been arrested in connection to last week's fatal shooting at the Catfish King restaurant.

Lt. David Young says Jarred Berwick turned himself over to authorities Sunday morning.  He has been charged with capital murder, aggravated robbery and aggravated assault.

The charges against Berwick and Buschman stem from their participation in the planning and carrying out of the robbery/homicide.

Lt. David Young tells the East Texas News that in Texas, an person can still face capital murder charges even though they may not have actually committed the act itself.

Last Sunday night, a manager of the restaurant, Katie Jeffreys and her boyfriend, Keith Labrozzi were leaving the business with the night deposit.

The couple was met by a gunman in the parking lot who attempted to rob them.

Jeffreys was shot in the foot.
