LUFKIN, TX (KTRE) -  Florida's win over Oklahoma gives the Gators their second national title in three years, but not everyone believes they are out right champs.  U.S. Representative Joe Barton of the Texas 6th district has introduced the College Football Playoff Act of 2009.

Barton is pushing legislation that would make it illegal to market or promote a post season game as a national championship, unless it's the result of a playoff system.  We couldn't catch up with the congressman today because he was traveling, but his office did send us a statement.

In the statement Barton says, "This years B.C.S. failures proves once and again that it's time for college football to come up with a fair way to determine it's champion.  If you don't believe me, just ask the thousands of fans in Southern California, Utah and Texas."

The playoff legislation does not give a specific system  It only says that all Division I Football Bowl Subdivision team should be equally eligible at the start of every season.
