HUDSON, TX (KTRE) - Deputies with the Angelina County Sheriff's Office arrested a 45-year-old man in connection to allegations that he sexually assaulted a 15-year-old girl at a home in Hudson in August of 2016.
Richard Brian Smith, 45, of Diboll, is still being held in the Angelina County Jail on a second-degree felony sexual assault of a child charge. His bond amount has been set at $65,000.
According to the arrest affidavit, the complainant met with an officer with the Hudson Police Department on Aug. 21, 2016. The woman had two minor-age girls with her, and she allegedly said that Smith had sexually assaulted one of the girls with her on a couch.
The Hudson PD officer took written statements from the victim and her friend, the affidavit stated.
At that point, the HPD officer scheduled a SANE exam for the next morning at the Harold's House location in Lufkin. The nurse was unable to discover any injuries consistent with sexual assault, but she was able to obtain a DNA sample from a piece of the girl's clothing, the affidavit stated.
During a forensic interview later that day, the victim gave the interviewer the same account of what had happened, the affidavit stated.
Then on Aug. 23, the Hudson Police Department obtained a search warrant and got a saliva sample from Smith.
The DNA samples from the victim and Smith were sent off to the Texas Department of Public Safety Crime Lab in Austin.
The officer who obtained the arrest warrant received a copy of the lab results on July 30, 2018.
According to the affidavit, the sample taken from the victim contained DNA from two people, and the report said that it is very likely that one of the people was Smith.
